FANFOOTBALL “WIN A FERRARI” PROMOTIONAL COMPETITION
In order to promote the FanFootBall subscription service (Hereinafter referred to as the “Service”), the provider of the Service, Smartcall Technology Solutions (Pty) Ltd, (Hereinafter referred to as the “Promoter”), is conducting the FanFootBall “Win a Ferrari” Promotional Competition (Hereinafter referred to as the “Promotional Competition”).
By entering the Promotional Competition, you agree to be bound by these Promotional Competition Terms and Conditions together with any other standard Terms and Conditions and/or Rules which may apply to the Service from time to time. In the event of a conflict between the standard Terms and Conditions and/or Rules, and these Promotional Competition Terms and Conditions, these Promotional Competition Terms and Conditions shall prevail to the extent of such conflict only
1. Who may enter (Hereinafter referred to as the “Entrant”) the Promotional Competition?
1.1 An Entrant must be at least 18 (Eighteen) years of age or have their guardians’ consent to enter the Promotional Competition.
1.2 If the Entrant does not own the handset from which he/she is entering the Promotional Competition and/or subscribing to the Service, the Entrant must ensure that he/she has the billpayers express consent prior to entering the Promotional Competition and/or subscribing to the Service.
2. Who may not enter the Promotional Competition?
2.1 Directors, members, partners, employees, agents, contractors and consultants of the Promoter and any other person who directly or indirectly controls or is controlled by the Promoter, as well as any person who supplies goods or services in connection with the Promotional Competition, and all of the aforementioned persons’ immediate families and life partners may not enter the Promotional Competition and shall not be eligible to be awarded any prizes in the Promotional Competition.
3. Promotional Competition Period
3.1 The Promotional Competition starts on the 16th of August 2021 and closes at midnight on the 22nd of May 2022 (Hereinafter referred to as the “Promotional Competition Period”), however the Promoter reserves its rights, to the fullest extent permitted by law, to amend, extend and/or curtail, at its sole discretion, the Promotional Competition Period.
3.2 Entrants who attempt to enter the Promotional Competition after it has closed will be notified that their entry has been unsuccessful as a result of the Promotional Competition Period having expired.
3.3 The Promoters will endeavour, wherever reasonably possible, to notify unsuccessful Entrants for a period of 30 (Thirty) days after the expiration of the Promotional Competition Period, that their entry was unsuccessful.
4. How to enter the Promotional Competition
4.1 Entries into the Promotional Competition will be free of charge to the Entrant and shall be awarded as follows;
4.1.1 All subscribers to the Service who are successfully subscribed during the Promotional Competition Period shall receive 1 (One) free entry for every R1.50 that is successfully billed during the Promotional Competition Period. As the Service is a subscription service which is billed at R3.00/day, a subscriber who is subscribed to the Service and is successfully billed in full, will receive 2 (Two) free entries into the Promotional Competition per day. If the subscriber who is subscribed to the Service is only able to be partially billed (in accordance with any applicable micro-billing processes applied by the subscribers’ mobile network provider), the subscriber will receive 1 (One) free entry into the Promotional Competition for every R1.50 that is successfully billed and collected.
4.1.2 In addition to receiving free entries into the Promotional Competition as a result of being successfully subscribed to the Service, an Entrant may opt to purchase access to additional FanFootBall content at a cost of R1.50/day using the USSD string *120*993# (USSD charges at 20c/20secs). Each successful purchase of access to additional FanFootBall content will be charged at R1.50 and will entitle the Entrant to 1 (One) free entry into the Promotional Competition (Network fees will apply).
4.1.3 An Entrant may choose to purchase access to additional FanFootBall content (at a cost of R1.50 each time) in accordance with clause 4.1.2 above, as often as they wish and will receive 1 (One) free entry into the Promotional Competition with each successful purchase.
4.1.4 An Entrant is not required to be subscribed to the Service to purchase access to the additional FanFootBall content using the USSD string *120*993# and will still receive 1 (One) free entry for each successful purchase.
4.1.5 An Entrant who is successfully subscribed to the Service can increase the number of free entries he/she receives by participating in the FanFootBall League, as follows;
18.104.22.168 The Top 10 FanFootBall managers per “game week” of the Promotional Competition Period will each earn additional free entries into the Promotional Competition as per clause 6 below.
22.214.171.124 The Top 20 FanFootBall managers in the “overall standings” at the end of the Promotional Competition Period will also each earn additional free entries into the Promotional Competition as per clause 6 below.
5. Charges to enter
5.1 Each Entrant who is successfully billed an amount of R1.50 (whether as a result of being subscribed to the Service or as a result of a purchase using the USSD string, or both) will receive a free entry into the Promotional Competition for each successfully billed amount of R1.50. There are no further charges for participating in the Promotional Competition (aside from the Entrants ordinary Network fees/charges) and the daily Subscription of R3.00/day which is billed to a subscriber of the Service is the normal subscription amount enabling the User of the Service to subscribe to the Service and to enjoy the various features and content offered on the Service.
6. Additional Entries
6.1 The Top 10 managers each “game week” will receive additional free entries as per the table below, provided that a minimum successful charge of R1.50 has been received each day.
6.2 No additional free entries will be received if the minimum payment has not been received and the additional free entries provided for in the table below will be voided i.e., the next person on the manager leader board at the end of the game week will not move up and receive these additional free entries.

6.4 By way of example;
6.4.1 If an Entrant placed 3rd in a game week and that Entrant had successfully been billed 7 (Seven) times (with a minimum of R1.50 each time), that Entrant would receive 7 (Seven) free entries PLUS an additional 8 (Eight) times 7 (Seven) equalling 56 (Fifty-Six) additional free entries for a total of 63 (Sixty-Three) free entries for that game week.
6.4.2 If on the other hand, the above Entrant had only been successfully billed (with a minimum of R1.50 each time) for 4 (four) days, that Entrant would receive 8 (Eight) times 4 (Four) equalling 32 (Thirty-Two) additional free entries to go with their 4 (four) free entries for a total of 36 (Thirty-Six) free entries for that game week.
6.5 The Top 20 managers in the “overall standings” at the conclusion of the Promotional Competition Period will receive additional free entries as per the table below;

7. Draw and Prizes
7.1 At the conclusion of the Promotional Competition Period, all of the valid entries will be entered into a final draw (Hereinafter referred to as the “Final Draw”) from which the first Entrant randomly drawn from the pool of entries will be the winner of the Ferrari 488 Spider (Hereinafter referred to as the “Prize”).
7.2 All entries will go into the same Final Draw and there will be only one winner of the Prize regardless of the source of the entry and/or whether the source of the entry was from www.fanfootball.mobi or any other marketing or promotional material.
7.3 The Promotional Competition and the random Final Draw which will determine the winner of the Prize will be overseen by the Promoter’s independent auditors Kaplin and Kaplin, or such other independent auditors at the Promotor may appoint from time to time.
8. Notification of winner
8.1 Once the Final Draw has taken place, the Promoter will use its best reasonable efforts to contact the winner telephonically, by calling the number that was used to enter the Promotional Competition.
8.2 In the event that the Promoter is unable to contact the winner as set out above, then that person’s right to win the Prize will be deemed to have been waived, and the Promoter may then randomly draw another winner from the pool of remaining entries.
8.3 As soon as reasonably possible after the Promotional Competition Period closes and with his permission, the name of the winner will be published on www.fanfootball.mobi.
8.4 With his/her permission, the image of the winner may also be published on www.fanfootball.mobi.
9.1 The Prize will be awarded to the Entrant who entered the Promotional Competition and who is in lawful possession of the SIM card that was used to enter the Promotional Competition, and the winner will also be required to identify him or herself by presenting such SIM card together with a valid form of identification, (or by such other reasonable means as determined by the Promoter), before the Prize can be redeemed.
9.2 The winning Entrant will also have to comply with any other reasonable, authorized validation procedures as may be reasonably required by the Promoter in order to claim the Prize.
9.3 If the winning Entrant is under the age of 18 (Eighteen) years of age at the time the Prize is awarded to him/her, they will not be eligible for the prize.
9.4 Delivery of the Prize to the winner will occur on such date and at such place as determined by the Promoter in its sole discretion and will be subject to the availability of the Prize, however the Promoter shall use all reasonable endeavours to award the Prize within 28 (Twenty-Eight) days of the Final Draw having been successfully concluded and the winner of the Prize having been successfully contacted and pursuant to all of the Promoters documentation and authentication processes having been successfully complied with by the winning Entrant.
9.5 The Promoter shall not be liable for any costs incurred by the winning Entrant in claiming or utilizing the Prize.
9.6 All risk in and to the Prize shall pass to the winning Entrant on delivery thereof.
9.7 The winning Entrant is liable for the insurance of the Prize together with any and all costs associated with owning and/or maintaining the Prize.
9.8 At the end of the Promotional Competition Period, all of the Promoter’s obligations in regard to the Promotional Competition as well as in regard to the Prize shall terminate.
9.10 The Promoter expressly reserves its right to substitute, at its sole and unfettered discretion, the Prize with another prize.
9.11 The winner of the Prize may substitute the Prize for a cash value expressly agreed to by the Promoter.
9.12 If the winner of the Prize is in arrears in regard to any debt due and owing to his or her mobile telecommunication service provider and/or the Promoter, then delivery of the Prize to such winner shall be withheld until the winner has settled such arrears in full.
9.13 In the event of a dispute with regards to any aspect of the Promotional Competition and/or these Promotional Competition Terms and Conditions, the Promoter’s decision will be final and binding and no correspondence shall be entered into therewith.
9.14 The Promoter is entitled, in its sole and unfettered discretion, to reject any entry or Entrant if it believes that there has been any irregular, fraudulent and/or mala fide conduct by, or on behalf of, such Entrant, and will not be obliged to notify Entrants of entries that are rejected.
9.15 All valid entries into the Promotional Competition have an equal chance of winning the Prize as determined by the random Final Draw.
9.16 The Promoter may refuse to award the Prize if any validly prescribed entry procedures or these Promotional Competition Terms and Conditions have not been adhered to, or if it detects and/or irregularities and/or male fide and/or fraudulent practices by, or on behalf of, any person claiming the Prize are reasonably suspected.
9.17 The Promotional Competition is also subject to, and must be read in conjunction with, the Promoter’s existing terms and conditions applicable to the use of its products and services together with any Rules applicable to the Service from time to time.
9.18 If the Promotional Competition is held to be, or becomes unlawful, or if the Promoter is required by the Minister of Trade and Industry, or the National Consumer Commission, or any other valid governmental organisation, to alter any aspect of the Promotional Competition, then to the full extent permitted by law, the Promoter reserves the right to suspend or terminate the Promotional Competition immediately and without notice, in which event all Entrants agree to waive any rights that they may have in terms of the Promotional Competition and accept that no recourse will lie against the Promoter.

9.20 This Promotional Competition is a lawful promotional competition as contemplated in Section 36 of the Consumer Protection Act of 2008.
9.21 The Promoter is a member of the Wireless Application Service Providers Association of South Africa (“WASPA”) and is bound by the WASPA Code of Conduct. Entrants have the right to approach WASPA to lodge a complaint in accordance with the WASPA complaints procedure. The Promoter may be required to share information relating to the Service or the Entrant and/or a customer with WASPA for the purpose of resolving a complaint. WASPA web site: www.waspa.org.za.
10.1 To the full extent permitted by law:
10.1.1 The Promoter, including inter alia, its associated companies, agents, contractors, consultants and employees, shall not be liable for any technical errors and/or failures affecting participation in, or the running of, the Promotional Competition, howsoever arising.
10.1.2 The Promoter, including inter alia, its associated companies, agents, contractors, consultants and employees, assume no liability whatsoever for any direct or indirect loss or damage, including consequential losses, death or injury arising from participation in the Promotional Competition, and/or subscribing to the Service, or from using the Prize or for any loss or damage, death or injury howsoever arising.
10.1.3 The Promoter assumes and/or accepts no liability whatsoever for any entry that has been omitted from participation for any reason whatsoever.
10.1.4 The Promoter may in its sole discretion amend these Promotional Competition Terms and Conditions at any time, without notice, and such amendment shall be deemed to have taken effect from the date of publication of the revised Promotional Competition Terms and Conditions on the website located at www.fanfootball.mobi and/or www.fanfootball.app .
10.1.5 The Promoter reserves the right to cancel, suspend or terminate this Promotional Competition, without notice at any time, and no liability shall lie against the Promoter, in favour of any Entrant or third party arising from such cancellation, suspension or termination.
